Regulamin świadczenia usług edukacyjnych / Terms and Conditions of Educational Services

§1. Postanowienia ogólne / General Provisions

  1. Regulamin określa zasady zakupu i realizacji usług edukacyjnych (lekcji muzyki, śpiewu oraz gry na instrumentach), świadczonych przez Konrad Szewczuk Music, jednoosobową działalność gospodarczą, ul. Grzegórzecka 69/205, 31-559 Kraków, NIP: 7343505045.
    / These Terms and Conditions define the rules for purchasing and providing educational services (music lessons, singing, and instrumental lessons) offered by Konrad Szewczuk Music, sole proprietorship, ul. Grzegórzecka 69/205, 31-559 Kraków, NIP: 7343505045.
  2. Usługi mogą być realizowane w formie stacjonarnej (w miejscu wskazanym przez Usługodawcę) lub online (z wykorzystaniem komunikatorów internetowych, np. Zoom, Skype).
    / Services may be delivered in person (at the location indicated by the Service Provider) or online (via communication platforms such as Zoom or Skype).
  3. Regulamin jest integralną częścią umowy zawieranej pomiędzy Usługodawcą a Klientem.
    / These Terms and Conditions form an integral part of the agreement between the Service Provider and the Client.
  4. Usługi edukacyjne świadczone są wyłącznie osobom, które ukończyły 18 lat. Osoby poniżej 18 roku życia nie mogą korzystać z lekcji.
    / Educational services are provided exclusively to persons who are at least 18 years old. Persons under the age of 18 are not permitted to take lessons.

§2. Zakres usług / Scope of Services

  1. Usługodawca oferuje:
    • lekcje jednorazowe,
    • pakiety 5 lekcji,
    • pakiety 10 lekcji.
      / The Service Provider offers:
    • single lessons,
    • 5-lesson packages,
    • 10-lesson packages.
  2. Wszystkie pakiety lekcji są opłacane z góry.
    / All lesson packages must be paid for in advance.

§3. Warunki płatności / Payment Terms

  1. Ceny usług podawane są w złotych polskich (PLN) i zawierają wszystkie wymagane podatki.
    / Prices are quoted in Polish zloty (PLN) and include all applicable taxes.
  2. Płatność dokonywana jest z góry, przelewem bankowym lub poprzez dostępne metody płatności elektronicznych.
    / Payments must be made in advance, either by bank transfer or via available electronic payment methods.
  3. Brak opłaty oznacza brak rezerwacji lekcji.
    / Failure to make payment means the lesson will not be reserved.

§4. Realizacja usług / Service Delivery

  1. Termin lekcji ustalany jest indywidualnie pomiędzy Klientem a Usługodawcą.
    / Lesson times are arranged individually between the Client and the Service Provider.
  2. Lekcje pakietowe należy wykorzystać w terminie:
    • 5 lekcji – w ciągu 3 miesięcy od dnia zakupu,
    • 10 lekcji – w ciągu 6 miesięcy od dnia zakupu.
      / Lesson packages must be used within the following periods:
    • 5 lessons – within 3 months from the purchase date,
    • 10 lessons – within 6 months from the purchase date.
  3. Niewykorzystane lekcje po upływie powyższych terminów przepadają i nie podlegają zwrotowi kosztów.
    / Unused lessons after the specified period will be forfeited and are non-refundable.

§5. Odwoływanie i zmiana terminu lekcji / Lesson Cancellation and Rescheduling

  1. Klient ma prawo do dowolnej liczby przełożeń ustalonego terminu lekcji, pod warunkiem poinformowania Usługodawcy najpóźniej na 24 godziny przed zajęciami.
    / The Client may reschedule lessons any number of times, provided that the Service Provider is informed at least 24 hours before the scheduled time.
  2. Brak informacji w wymaganym terminie skutkuje uznaniem lekcji za zrealizowaną.
    / Failure to provide notice within the required timeframe will result in the lesson being considered delivered.
  3. Odwołane lekcje mogą zostać odrobione w innym ustalonym terminie, pod warunkiem dostępności grafiku Usługodawcy.
    / Cancelled lessons may be rescheduled subject to the Service Provider’s availability.

§6. Brak prawa odstąpienia od umowy / No Right of Withdrawal

  1. Zgodnie z art. 38 ust. 1 pkt 12 ustawy o prawach konsumenta, Klientowi nie przysługuje prawo odstąpienia od umowy zawartej na odległość w przypadku umów o świadczenie usług związanych z wydarzeniami rozrywkowymi, sportowymi lub kulturalnymi, jeżeli w umowie oznaczono dzień lub okres świadczenia usługi.
    / According to Article 38(1)(12) of the Polish Consumer Rights Act, the Client has no right of withdrawal from a distance contract for services related to leisure, entertainment, sports, or cultural events, if the contract specifies a date or period of service delivery.
  2. Lekcje indywidualne (jednorazowe oraz pakiety lekcji) stanowią usługę świadczoną w określonym terminie, dlatego zakup jest bezzwrotny.
    / Individual lessons (single or packages) are provided on a specific date or within a specified period, therefore all purchases are non-refundable.
  3. Klient, dokonując zakupu lekcji, wyraża zgodę na rozpoczęcie świadczenia usług przed upływem 14 dni od dnia zawarcia umowy i jest świadomy, że tym samym traci prawo do odstąpienia od umowy.
    / By purchasing lessons, the Client agrees to the commencement of service provision before the 14-day withdrawal period expires and acknowledges that this waives the right of withdrawal.

§7. Reklamacje / Complaints

  1. Klient ma prawo zgłosić reklamację dotyczącą jakości świadczonej usługi.
    / The Client has the right to file a complaint regarding the quality of the service.
  2. Reklamacje należy składać drogą elektroniczną na adres e-mail: kontakt@musicvoxstudio.pl
    / Complaints should be submitted via email to: kontakt@musicvoxstudio.pl
  3. Reklamacje będą rozpatrywane w terminie 14 dni od daty zgłoszenia.
    / Complaints will be reviewed within 14 days of submission.

§8. Dane osobowe / Personal Data

  1. Administratorem danych osobowych Klienta jest Konrad Szewczuk Music, ul. Grzegórzecka 69/205, 31-559 Kraków, NIP: 7343505045.
    / The administrator of the Client’s personal data is Konrad Szewczuk Music, ul. Grzegórzecka 69/205, 31-559 Kraków, NIP: 7343505045.
  2. Dane osobowe są przetwarzane wyłącznie w celu realizacji usług edukacyjnych oraz obsługi płatności.
    / Personal data is processed solely for the purpose of providing educational services and processing payments.
  3. Klient ma prawo wglądu do swoich danych, ich poprawiania oraz żądania usunięcia.
    / The Client has the right to access, correct, or request deletion of their data.

§9. Postanowienia końcowe / Final Provisions

  1. Regulamin wchodzi w życie z dniem 01.01.2024 r.
    / These Terms and Conditions take effect on January 1, 2024.
  2. W sprawach nieuregulowanych regulaminem zastosowanie mają przepisy prawa polskiego.
    / Any matters not covered by these Terms and Conditions shall be governed by Polish law.
  3. Usługodawca zastrzega sobie prawo do wprowadzania zmian w regulaminie. O zmianach Klienci będą informowani drogą elektroniczną lub poprzez stronę internetową www.musicvoxstudio.pl.
    / The Service Provider reserves the right to amend these Terms and Conditions. Clients will be notified of any changes by email or via the website www.musicvoxstudio.pl.
